1.1 These Terms of Service (the "Terms") govern Customer's access to and use of sitedote.com (the "Site") and the WordPress security, repair and maintenance services offered through it (the "Services"). By clicking "I agree" (or a similar button or checkbox), placing an Order, completing the sign-up or checkout flow, or accessing or using the Services, Customer agrees to these Terms as of that date (the "Effective Date"). If the individual accepting these Terms does so on behalf of a company or other legal entity, that individual represents that they have authority to bind that entity, and "Customer" refers to that entity. If Customer does not agree to these Terms, Customer must not access or use the Site or the Services.
1.2 These Terms are entered into between Edevos EOOD, registered in Bulgaria, UIC (EIK) 205573828, with its registered office and address of management at 68 Saedinenie Str., Shumen, Bulgaria ("Sitedote", "we", "us"), and Customer. Sitedote is our trade name. VAT ID: BG205573828 (registered under Art. 97a of the Bulgarian VAT Act; VAT is not charged).
1.3 In these Terms:
1.4 The Services are made available for Customer to protect and maintain websites that Customer owns, operates or is authorised to manage, and not the websites, platforms or operations of any third party for which Customer has no authority. Customer confirms it is entitled to instruct us on every site it submits.
1.5 These Terms, your Order, and the Data Processing Addendum in Section 11 form the entire agreement between you and us for the Services. Notices to Sitedote required by these Terms must be sent by email to [email protected]. Notices to Customer may be sent to the email address associated with Customer's account or posted within the Site.
2.1 One-time services. Malware and infection cleanup for a WordPress website, including a scan, identification and removal of malicious code, restoration of affected core files, basic hardening and a short written report.
2.2 Maintenance plans. Recurring services described in your plan, which may include backups, core, plugin and theme updates, uptime and security monitoring, and a limited number of hours per month for minor corrections. The plan description at the time of your Order defines what is included.
2.3 Free tools. We may offer free tools (for example a website check) on an "as is" basis. They give general indications only and do not replace a full review.
2.4 Standard of performance. We provide the Services with reasonable skill and care. We do not promise a particular result, response time or outcome unless it is stated in your Order.
2.5 What is not included. Unless your Order says otherwise, the Services do not include: hosting or server administration; licences for third-party plugins, themes or software; redesign, new features or content changes; recovery of data for which no backup exists; legal, forensic or regulatory breach-response work; or work on sites that are not built on WordPress.
2.6 Changes to the Services. We may improve or change the Services. If a change materially reduces what a paying Subscription includes, we will give you at least 30 days' notice, and you may cancel before the change takes effect.
2.7 Subcontractors. We may use subcontractors and tools to deliver the Services and remain responsible for their work under these Terms.
3.1 Business use. The Services are designed for businesses, agencies and professionals. When you place an Order you confirm that you are acting as a Business Customer, unless you tell us otherwise before paying.
3.2 Consumers. If you are a Consumer under the mandatory law of the country where you live, the provisions of these Terms, including Section 14, are modified to the minimum extent required by that law, and nothing in these Terms limits a right you have under that law that cannot be excluded by contract.
3.3 Local courts. Consumers in the European Union, the United Kingdom and Australia keep the right to bring claims in the courts of their country of residence and are not subject to arbitration or to any class action waiver in these Terms.
3.4 Right of withdrawal (EU and UK consumers). If you are a Consumer in the EU or the UK, you may withdraw from your Order within 14 days from the day the contract is concluded, without giving a reason. To do so, send a clear statement to [email protected]. We will refund what you paid within 14 days of receiving your notice, using the same payment method. We honour this right in full, including where the Services have already been started or completed.
3.5 Australian consumer guarantees. Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, condition or warranty, that you have under the Australian Consumer Law or any other law and that cannot lawfully be excluded, restricted or modified.
3.6 Customers in the United States. Business Customers in the United States are bound by the Delaware governing law in Section 13 and by the arbitration, jury-trial waiver and class action waiver in Section 14. If you are a Consumer in the United States, you may opt out of arbitration and the class action waiver within 30 days of your first Order, as described in Section 14.7. We do not offer a separate cooling-off period beyond the 30-day guarantee in Section 5.1. Section 11.3 describes how we handle personal data under California and other US state privacy laws. Nothing in this Section limits rights you have under mandatory US federal or state consumer law.
4.1 Ordering. A contract is formed when we confirm your Order (by email, dashboard notice or by starting the work). We may decline an Order, for example where we cannot serve the site or suspect abuse.
4.2 Prices and currency. Prices are shown in euros (EUR) unless stated otherwise and are the final amount you pay at checkout. Payments are processed by our payment provider, Stripe, and we do not store your full card details.
4.3 Prepayment. Services are paid in advance. We start work once payment is received, unless we agree otherwise in writing.
4.4 Subscriptions and auto-renewal. A Subscription renews automatically for successive periods of the same length as the initial period (for example monthly or yearly) until you cancel. The price, renewal period and cancellation method are shown before you pay. You can cancel at any time from your account or by email to [email protected]; cancellation takes effect at the end of the current paid period and no further charges are made. We will send a reminder before annual renewals.
4.5 Price changes. We will give at least 30 days' notice before a price change applies to a Subscription. If you do not accept it, you can cancel before it takes effect.
4.6 Taxes. We do not currently charge VAT, GST or sales tax on our prices. For Business Customers in the EU with a valid VAT number, the reverse-charge mechanism applies and the customer accounts for VAT in its own country. You are responsible for any taxes, duties or withholdings that arise in your country and are not included in our prices. If we later become required to charge VAT or another tax, we will tell you in advance and apply it only from your next renewal or new Order.
4.7 Invoices. Provide accurate billing details (company name, address, VAT or tax ID where relevant) when you order. We issue invoices for each payment. Please check the details before requesting an invoice; corrections after issue may require a credit note and a new invoice.
4.8 Late or failed payment. If a payment fails, we will try to collect it and notify you. If it remains unpaid after a grace period of 5 days, we may suspend the Services and, if still unpaid, terminate the contract. You remain liable for amounts due.
4.9 Payment disputes. Before starting a chargeback or payment dispute with your bank, please contact us at [email protected] so we can resolve the issue. We may provide the records of the Services to your bank or payment provider.
5.1 30-day guarantee for Subscriptions. You may cancel a Subscription within 30 days of the start of the initial term or of any renewal, and we will refund the fee for that term, provided that you have not submitted a Malware Removal Request during that period.
5.2 One-time cleanup. If the malicious code we were engaged to remove reappears on the same site within 5 days after we mark the work as completed, and it was not caused by a new compromise, an outdated component we told you to update, or access you gave to others, we will clean it again at no charge. If we cannot do so, we will refund the cleanup fee.
5.3 Otherwise non-refundable. Except as set out in this Section 5 or as required by mandatory law, fees are non-refundable once the Services have started, and no refunds are given for partially used periods.
5.4 Consumer rights. Section 3 applies to Consumers. Nothing in this Section 5 limits statutory rights, including for services that are not performed or are performed with a material defect.
5.5 Errors. If we charge you twice or in error, we will refund the difference.
5.6 Goodwill. We may, at our discretion, grant a refund or credit outside these rules. Doing so in one case does not create an obligation in any other case.
5.7 How refunds are made. Refunds are made to the original payment method, normally within 14 days of our decision. Your bank may need additional time to show the credit.
6.1 Backups. You are responsible for keeping a current, complete backup of the Customer Site (files and database) before we start any work. We may take a backup as part of the Services, but you should not rely on it as your only copy. To the extent permitted by law, we are not liable for data loss where you did not keep a usable backup.
6.2 Access. You must give us the access we reasonably need (for example WordPress admin, hosting panel, SFTP or database credentials) and confirm that you are entitled to grant it. Use a temporary or dedicated account where possible, and change your credentials after the work is done.
6.3 Accurate information. You must give us accurate information about the Customer Site, its hosting and any known problems.
6.4 Pre-existing issues. We are not responsible for problems that existed before we started, for previously undetected compromises outside the agreed scope, or for the condition of hosting, servers or networks that we do not control.
6.5 Third-party software. We do not control and are not responsible for third-party plugins, themes, hosting providers, CDNs or services. Updating or removing them may affect how your site works; you accept that risk.
6.6 Lawful use. You must not use the Services for unlawful content or activity, and you must have the rights to the content and site we work on.
6.7 Cooperation. Delays caused by missing access, information or approvals from you may extend delivery times.
7.1 Your content. You keep all rights in the Customer Site and its content. You grant us a limited, non-exclusive, worldwide licence to access, copy, analyse and modify it only as needed to provide the Services.
7.2 Our materials. We keep all rights in the Site, our tools, scripts, methods, reports and know-how, and in any improvement to them. While your contract is active, we grant you a limited, non-exclusive, non-transferable licence to use the reports and outputs we deliver for your own internal business purposes.
7.3 Restrictions. You may not copy, resell, reverse engineer or build a competing service from our tools or materials, or use the Site to send automated queries that harm its operation.
7.4 Feedback. If you give us suggestions or feedback, we may use them without restriction or payment to you.
7.5 Third-party components. Third-party plugins, themes and software remain subject to their own licences, which you must comply with.
8.1 No guarantee of security. No security, malware-removal or monitoring service can guarantee that every vulnerability, infection or attack will be found, removed or prevented. We do not guarantee that a site will be free of malware, that it will not be compromised again, or that it will not be blocklisted, penalised or affected by third-party services.
8.2 As is. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, THE SITE AND ANY FREE TOOLS ARE PROVIDED "AS IS" AND "AS AVAILABLE". EXCEPT AS EXPRESSLY STATED IN THESE TERMS, WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION AND ERROR-FREE RESULTS.
8.3 Third parties. We are not responsible for the acts or omissions of hosting providers, plugin or theme authors, attackers or other third parties.
8.4 Mandatory rights. Nothing in this Section 8 excludes or limits any warranty or right that cannot be excluded or limited by law, including the rights of Consumers described in Section 3.
9.1 Cap. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES AND THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE TOTAL FEES YOU PAID TO US FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT THAT CAUSED THE LIABILITY.
9.2 Excluded damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF GOODWILL OR BUSINESS INTERRUPTION, EVEN IF WE WERE ADVISED OF THEIR POSSIBILITY.
9.3 What is not limited. Nothing in these Terms limits or excludes liability for death or personal injury, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, or for anything else that cannot be limited or excluded under the law that applies to you.
9.4 Third parties and pre-existing issues. We are not liable for damage caused by third-party actions, by problems that existed before our work, or by your failure to keep backups or follow our written recommendations.
9.5 Basis of the bargain. You accept that the fees reflect this allocation of risk, and that these limits apply even if a remedy fails of its essential purpose.
10.1 Business Customers. If you are a Business Customer, you will defend and indemnify us against third-party claims, and the resulting losses, damages and reasonable legal costs, arising from: (a) the content of the Customer Site or your use of it; (b) your breach of these Terms or of law; or (c) access or credentials you gave us without being entitled to do so.
10.2 Procedure. We will tell you promptly about a claim, let you control its defence (we may take part at our own cost), and cooperate with you at your cost. You may not settle a claim in a way that imposes obligations or admissions on us without our written consent.
10.3 Consumers. This Section 10 does not apply to Consumers.
11.1 Our role. For personal data that we process on your behalf while working on the Customer Site (for example visitor, customer or user data stored in the site or its database), you are the controller (or business) and we are the processor (or service provider). For your account and billing data, we are a controller and act under our Privacy Policy.
11.2 Data Processing Addendum. Our Data Processing Addendum ("DPA"), available at sitedote.com/dpa, forms part of these Terms and applies to personal data covered by the GDPR, the UK GDPR, the Swiss FADP and other applicable data protection laws. If there is a conflict between the DPA and these Terms on personal data, the DPA prevails.
11.3 California and other US states. To the extent the CCPA/CPRA or another US state privacy law applies, we act as a service provider or processor. We will not sell or share personal data covered by the DPA and will not use it outside the business purposes described in the DPA.
11.4 Transfers. Where personal data is transferred outside the EEA, the UK or Switzerland to a country without an adequacy decision, the Standard Contractual Clauses (and the UK Addendum where relevant) set out in the DPA apply.
11.5 Security and incidents. We use appropriate technical and organisational measures, described in the DPA. We will notify you without undue delay, and in any case within 72 hours, after becoming aware of a personal data breach affecting data we process for you.
11.6 Your obligations. You are responsible for having a lawful basis and any notices or consents needed for us to process personal data on the Customer Site, and for the accuracy of the data you give us.
11.7 Credentials and access data. We use access credentials only to deliver the Services and delete or ask you to revoke them when the work ends.
12.1 Term. These Terms apply from your first Order or use of the Services. One-time services end when the work is delivered. Subscriptions run for their paid period and renew as described in Section 4.4.
12.2 Termination by you. You may cancel a Subscription at any time as described in Section 4.4 and Section 5.
12.3 Termination by us or by either party for breach. Either party may terminate the contract by written notice if the other party materially breaches these Terms and does not fix the breach within 15 days of notice. We may also terminate immediately if you use the Services unlawfully or in a way that puts our systems or other customers at risk.
12.4 Suspension. We may suspend the Services if a payment is overdue after the grace period in Section 4.8, or if needed to prevent harm or comply with law. We will tell you the reason and restore the Services once the cause is resolved.
12.5 Effect of termination. Your right to use the Services ends. Amounts already due remain payable. We will return or delete Customer Site data in our possession within 30 days, unless the law requires us to keep it, and we may keep backups for a limited period in the ordinary course of business.
12.6 Survival. Sections 6.1, 7, 8, 9, 10, 13, 14 and 15, and any other provision that by its nature should survive, continue after termination.
13.1 The Americas. If you are headquartered or domiciled in North, Central or South America, these Terms and any dispute arising out of or related to them are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules.
13.2 Everywhere else. If you are headquartered or domiciled anywhere else, these Terms and any dispute arising out of or related to them are governed by the laws of the Republic of Bulgaria, without regard to its conflict-of-law rules.
13.3 Exclusions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
13.4 Consumers. If you are a Consumer, the choice of law in this Section 13 does not deprive you of the protection of the mandatory rules of the country where you live.
14.1 Informal resolution first. Before starting any formal proceeding, the party with a complaint will send a written notice describing it to the other party (to [email protected] in our case), and both parties will try in good faith to resolve it for 30 days.
14.2 Binding arbitration. If the dispute is not resolved, any dispute or claim between us arising out of or related to these Terms or the Services, including tort as well as contract claims and whether pre-contractual or extra-contractual, and including the arbitrability of any dispute, must be referred to and finally settled by binding arbitration, as follows:
14.3 How the arbitration runs. There will be one arbitrator. The language is English. The arbitration will be conducted by telephone, online, and/or on written submissions where no in-person appearance is required. If an in-person hearing is required, it will be held in New York City or Sofia, as applicable. The arbitrator applies the law in Section 13. An award may be enforced by any court with jurisdiction.
14.4 Jury and class waiver. To the extent permitted by law, each party waives the right to a jury trial and agrees to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative action.
14.5 Exceptions. Either party may (a) seek urgent injunctive or other interim relief from a court of competent jurisdiction, (b) bring claims for infringement or misappropriation of its intellectual property in court, and (c) bring an individual claim in small-claims court where it qualifies.
14.6 Consumers in the EU, UK and Australia. Sections 14.2 to 14.4 do not apply to you. You may bring a claim in the courts of the country where you live, and we will not require you to go to arbitration or to give up class or collective proceedings that the law gives you.
14.7 Consumers in the United States. You may opt out of arbitration and the class action waiver by emailing [email protected] within 30 days of your first Order, stating your name and that you opt out. If you opt out, disputes will be resolved in the courts of the State of Delaware, and the rest of these Terms continue to apply.
14.8 Fees. Each party bears its own costs, and the arbitration fees are shared as the applicable rules provide, unless the rules or mandatory law require otherwise.
15.1 Changes to these Terms. We may update these Terms. For material changes we will give at least 30 days' notice by email or on the Site before they apply to you. If you continue to use the Services after the effective date, you accept the update. If you do not accept it, you may cancel before it takes effect.
15.2 Entire agreement. These Terms, your Order and the DPA are the entire agreement on their subject and replace earlier discussions and terms. Any different terms in your purchase order are rejected.
15.3 Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or a successor to our business.
15.4 Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including outages of hosting, network or payment providers, attacks and natural events.
15.5 Severability and waiver. If a provision is held invalid or unenforceable, it will be modified to the minimum extent needed and the rest remains in force. A failure to enforce a provision is not a waiver of it.
15.6 No third-party rights. These Terms do not give rights to anyone other than the parties.
15.7 Notices. We may send notices to the email address on your account. You may send notices to [email protected] and to Edevos EOOD, 68 Saedinenie Str., Shumen, Bulgaria.
15.8 Language. These Terms are written in English, and the English version prevails over any translation.
15.9 Contact. Edevos EOOD, 68 Saedinenie Str., Shumen, Bulgaria, UIC/EIK 205573828, email [email protected]. Last updated: 19 September 2026.
